VENDORS ARE RESPONSIBLE TO INFORM PARTICIPANTS AND OR EMPLOYEES OF THIS INFORMATION.Vendor Instructions, Rules, and RegulationsI agree and have read the Vendor Instructions, Rules, and RegulationsThe Westminster Pride Festival welcomes the participation of all people regardless of age, creed, gender, gender identity, HIV status, national origin, physical or mental development ability, race, religion or sexual orientation and asks all participating organizations to also engage in nondiscriminatory actions. Participants are to show respect for all genders, ages, races, cultures, faiths and sexual orientations and are to be aware that children will be in attendance at the festival. Participants are asked to demonstrate good taste throughout the event. Westminster Pride Festival organizers will assign a booth location prior to the event. Check your email for a booth location and any possible unloading instructions. Vendors are responsible for supplying, carrying, and setting up their tables, chairs, canopy, literature, decorations, products, and supplies. Vendors are only permitted to drive vehicles to/from their booths in the allotted setup time before the festival, and the breakdown following the festival. During actual festival hours vendors may walk in additional products. Vendors must cooperate with each other and respect the integrity of downtown Westminster while transporting and removing their wares and equipment. The Westminster Pride Festival will not be able to provide you with power or electricity. We will be ready for your business/organization to arrive starting at 10:00 am. If you arrive earlier you may need to wait until the road has been securely block for the festival. Please arrive no later than 10:00 am and have your area set up and ready by 12 Noon, when the event officially starts. All vehicles must be removed from the festival street by 11:45am. No vehicles may remain on the street during the festival. The Pride Festival will take place rain or shine. Canopies are encouraged, but not required. If it rains, booths can’t move under another covered space (i.e. a bridge or other tent). Weight canopies in case of wind. Stakes cannot be used to affix canopies to the ground/surface. Please use sandbags or water weights. The Festival ends at 5:00 pm, at which time you are required to close up your booth and canopy and pack up any remaining inventory, flyers, literature, banners and trash around your booth. You may break down starting at 4:30pm if you find booth traffic is diminished, or if the weather has become poor. You will be responsible for complete setup and breakdown of your booth. Vendors who remove and/or damage Pride Festival property may be assessed with a damage fee (up to $100.00). There is to be no solicitation of cash donations. Items can, however, be sold or given away. Any organization (including non-profits that sells items) must apply as a paying business booth. Any booth selling items is responsible for making sure sales meet all City, County, State, & Federal tax collection and local business permit regulations. No games of chance are permitted. This includes raffles, bingo, carnival games, lottery, wheels of chance, etc., or other similar activities requiring money. Free spins for promotional items are permitted as long as no payment is accepted. Only designated food/alcohol vendors may sell those items. Food vendors are required to provide a copy of their Special Events Health License for the City of Westminster. Please follow the link on our website to acquire the license. Any applications received without this license will be rejected. All food vendors must comply with all health regulations including being fully clothed at all times. Any vendor not complying with these items will forfeit vendor fees and will be asked to leave the festival. Nudity at public events is against local and state laws and will not be allowed. All vendors must be compliant with obscenity laws. As the planning committee, we reserve the right to remove anyone from the festival that is not conforming to our reasonable restrictions in their manner of dress. We further reserve the right to prohibit the display of any signs, articles or products that, in our sole opinion, are not in keeping with the desired image, nature and character of the festival. We have the legal right to control the message of our event and to exclude individuals expressing a contrasting or contradictory message. The Westminster Pride Festival Planning Committee reserves the right to cancel applications from organizations or individuals that do not support the mission and values of the festival. This can be found on our “About Us” page of our website. Although unlikely, protesters may show up. Westminster City Police Department officers are aware of our Pride Festival and will be checking in on a regular basis. Please refrain from any interaction with all protesters before, during, and after the event. The Westminster Pride Festival reserves the right to cancel an event due to low enrollment or other circumstances which would make the event non-viable. Should circumstances arise that result in the postponement of an event, vendors will be able to transfer registration to the same event at the new or future date. No refunds will be made available in the case of an early closure of the event due to inclement weather and/or emergency. As it is impossible to anticipate every situation that may arise, any conduct that violates statutes of the State of Maryland or the City of Westminster will not be tolerated. Any company, organization or individual violating these statues will not be allowed to participate in the Pride Festival. Waiver of LiabilityI have read and agree to the Waiver of LiabilityThe agreement to rent a booth space is made upon the express condition that the City of Westminster, The Westminster Pride Festival, and their planning team and volunteers, hereinafter referred to as the Lessor, shall be free from all liabilities and claims for damages and/or suits for or by reason of any injury or injuries to any person or persons or property of any kind whatsoever, whether the person or property of Lessee, Its agents or employees, or third persons, from any cause or causes whatsoever while in or upon said premises or any part thereof during the term of this agreement or occasioned by any occupancy or use of said premises or any activity carried on by lessee in connection therewith. The Lessee hereby covenants and agrees to indemnify and save harmless the Lessor from all liabilities, charges, expenses (including counsel fees) and costs on account of or by reason of any such injuries, liabilities, claims, suits, or losses however occurring or damages growing out of same. The Lessee warrants and guarantees that Lessee is property insured for all time periods and places covered by this agreement. The Lessee agrees to assume all risks of loss, injury or damage of any kind or nature whatsoever to any building or other structure belonging to said Lessee, which may be now or hereafter placed upon all leased premises, and all risks of loss, injury, or damage of any kind or nature whatsoever to the contents of any building or structures, or to any goods, merchandise, chattels, or any other property now or that may hereafter be upon said leased premises, whether belonging to the Lessee or others, and whether such loss, injury from, fire, or other agency, and whether the same be caused by the negligence of the Lessor, or any of its volunteers or agents, or otherwise, and to save and keep harmless the Lessor from all claims and suits growing out of such loss, injury, or damage. Guidelines of behavior and procedures for volunteers and vendorsI have read and agree to the guidelines of behavior and procedures for volunteers and vendorsWestminster Pride Festival has established the following guidelines of behavior and procedures for volunteers and vendors to accomplish a safe environment. All volunteers and vendors are expected to follow these guidelines: Physical and sexual abuse, including, but not limited to, striking, hitting, kicking, biting, indecent gesturing, indecent exposure, unwanted physical contact, any form of sexual contact or inappropriate touching and destruction or appropriation of another’s property are strictly prohibited. Emotional and verbal abuse are also prohibited. These include, but are not limited to, such forms of abuse as: yelling, insulting, threatening, mocking, demeaning behavior or making abusive statements in regard to a person’s race, gender, religion, nationality, ethnicity, sex or age. No vendor or volunteer should be in possession of dangerous weapons, instrument or substance that is used for, or is readily capable of, causing death or serious bodily injury or destruction to property.
